Man forces entry to pursue partner following argument

Malta Independent Friday, 22 August 2014, 12:54 Last update: about 11 years ago

A 22-year-old man ended up in court today after an argument with his partner saw him following her to her friends’ home and force an entry after he was not allowed inside.

The argument took place yesterday evening, and Wayne Borg’s partner took her children with her as she sought shelter at her friends’ house in Birzebbuga.

But Mr Borg followed her there, and when her friends did not let him in to talk to her or see the children, he forced open the front door and a commotion ensued. The police were brought in, but Mr Borg resisted arrest, incurring further charges in the process.

Mr Borg was ultimately accused of assaulting two police officers, slightly injuring one of them, threatening, insulting and, slightly injuring his partner, damaging other people’s property, disobeying legitimate police orders and breaching the public peace.

The defence insisted that the case was a small incident between a couple which was escalated through the intervention of third parties, arguing that the charge sheet made the incident seem far more serious than it actually was.

Bail was sought, but prosecuting inspector Kevin Pulis objected due to the fear of tampering of evidence.

Magistrate Carol Peralta ultimately decided to grant Mr Borg bail against a €300 deposit and a €2,700 personal guarantee, ordering him to reside at his mother’s home and not to approach his partner or her friends.

Mr Borg questioned how he would be able to see his children without talking to his partner, but was sternly rebuked by the magistrate, who warned that he would be rearrested if he did so and suggested that he should get a lawyer to sort out access to his children.
