The 17-year-old unlicensed driver who drove a car into a bus-stop in Mtarfa, instantly killing a pensioner and seriously injuring another on Monday, was granted bail against a personal guarantee of 5,000 euros and must be home at 11pm.

The court accepted the request of the defence counsel, which was not opposed by the prosecution, to grant bail to the accused against a set of conditions.

The accused is from Naxxar. He was charged with causing the death of Azzopardi when he drove a car without a licence and without an insurance cover, and seriously injuring Joseph Vella in the process.

He was also charged with damaging a vehicle, a Toyota Tercel, belonging to his father, the damage of which goes beyond 1,000 euros while also being charged with theft of the vehicle.

The court imposed a ban on the publication of the boy's name. Another condition the prosecution team requested was that the boy does not go to Mtarfa, the locality where the victim's family resides and where the accident occurred.

Dr Gianluca Caruana Curran appeared for the accused while Police Inspector Edel Mary Camilleri prosecuted.
