Court to decide on garnishee order against More Supermarkets of Hamrun

The First Hall of the Civil Court is to decide whether it will confirm a request for a garnishee order filed by Agdel Co. Ltd against More Supermarkets Hamrun Ltd, which was operating the Hamrun supermarket at Daniel's Shopping Complex.

More Supermarkets Hamrun Ltd filed a counter protest to have the warrant of prohibitory injunction revoked.

Lawyer Stefano Filletti, wo appeared on behalf of Agdel Co. Ltd, told the court that his clients are owed (by More of Hamrun) the sum of €380,000 in rent money and energy bill arrears.

Lawyer James D'Agostino, who appeared on behalf of More Supermarkets Hamrun Ltd, said that his clients have nothing in writing that shows they have a commercial relation with Agdel since the rent agreement is with Cassar and Schembri (Marketing), one of its directors being Ryan Schembri, who fled Malta as soon as the company he represented started encountering financial problems.

Dr Filetti argued that when More Supermarkets Hamrun Ltd bought off the shares of Cassar and Schembri (Marketing), the operations of More Supermarket of Hamrun had agreed that the invoices of payment for rent would start to be issued in the name of Agdel Col. Ltd.

Dr Filletti said that More Supermarkets Hamrun Ltd is trying to avoid shouldering responsibility when it says it does not want to pay rent arrears because there is nothing in writing that shows there are commercial ties. He also argued it is hiding its identity behind another two companies which form part of the same company.
Agdel, which also forms part of DA Holdings Ltd, the owners of Daniels Shopping Complex of Hamrun, said that if the court does not confirm the warrant of prohibitory injunction, it would be near to impossible to collect the funds owed to them.
