Judicial protest against Cospicua local council filed over waste management services

Thursday, 26 March 2015, 16:05 Last update: about 10 years ago

A waste management company has requested the Cospicua local council to end a contract given to an individual for household waste management, and has asked for compensation claiming he is not moving along with an Appeals Court decision.

The Judicial protest against Alison Zerafa Civelli and Joseph Caruana, as Mayor and Executive Secretary of the Bormla local council, the company WM Environmental Ltd referred to the Court's decision on 11 November. In that sentence, the council was ordered to cancel the contract it gave to Saviour Mifsud and re-evaluate the offers received.

The company alleged that the local council's legal counsel, Luciano Busuttil, is defending Saviour Mifsud in a court case, resulting in a possible conflict of interest.

The Court of Appeals cancelled the contract and ordered the Attorney General, the Director of Contracts and the Commission for the Administration of Justice to investigate whether such a conflict of interest exists.

Within the protest, WM Environmental Ltd said that the only thing the Cospicua council has done is change legal counsel, and that Mr Mifsud was still conducting waste management, even though a call for applications was issued.

Dr John Bonello filed the protest.
