Man in 'on again, off again' relationship charged with raping mother of his child

A man today was charged with raping the mother of his child and said that the sexual act was consensual up until half way through, when his girlfriend chose to withdraw consent.

He pleaded not guilty to rape. The names cannot be published by court order. The couple had been together for eight years, the Court heard, and have a young child.

The man was charged with rape, holding the woman against her will, causing slight injury and breaching previous court conditions.

Defence Lawyer Joe Giglio said that the couple had an “on again off again” relationship and that according to his client, the girlfriend filed the rape complaint as her consent was withdrawn half way through the act.

Dr Giglio said his client was not requesting bail, however asked the court to appoint an expert who would examine their mobile phones. The prosecution asked the court to appoint an expert to extract audio from the woman’s mobile of the alleged rape.

Magistrate Josette Demicoli upheld the requests.
