Police will request court to disallow former Police Commissioner from being parte civile

The police will request the court to remove former Police Commissioner Peter Paul Zammit as parte civile in a case against his former client Josmar Agius over an incident at the Zabbar Police station, which had caused a huge uproar and resulted in an inquiry into the former Commissioner's actions at the time.

Responding to questions sent by this newsroom, the police said that "after seeking legal advice on this issue, it has been stated that he (Dr Zammit) does not have a legal right to be ex parte in these proceedings, and as such the prosecuting officer will be requesting the presiding magistrate to change its decree".

A recent inquiry report into the former Commissioner's decision to drop the charges against Josmar Agius, the man who is charged with slightly injuring a police officer, found Dr Zammit had acted on his own accord when he stopped police proceedings against the man - a former client of Dr Zammit when he had served as a lawyer.

In an interview with The Malta Independent, Mr Zammit said: "They have their opinion and I have mine. It's a legal issue. I have no problem with making legal history, as this is the way laws are challenged and develop."
