Court clears foreigner after he ran over man holding gun to prevent shooting

A man was cleared of running over another man after the court ruled that he did so in defense of others.

On 11 October 2010, Nure Kumakam was driving through Mosta Road, St Paul's Bay, when he noticed Said Bouslama pointing a gun at another man, Ahmed Muhammed Mustapha Alouzi. 

He pulled over, and tried to calm down the man holding the gun. But in turn, Mr Bouslama pointed his gun at him and warned him not to get involved, or 'he'll get shot'. It was then that Mr Kumakam got back into his vehicle, did a U-turn and drove over him.

In turn, he ended up being charged with running over Mr Bouslama, causing him grievous injuries and driving recklessly.

In court, Inspector Theresa Schiberras explained that someone had called the police saying there was an armed man at St Paul's Bay. When the police arrived on scene, the gunman had been run over and was taken to hospital by ambulance. 

The Inspector told the court that the buttstock of a gun was retrieved from the scene of the incident and the other part of the gun was later discovered by a diver in St Paul's Bay. It is thought the gun had broken when Mr Bouslama was hit by the vehicle.

Questioned by the police, Mr Bouslama claimed that he was only speaking to Mr Alouzi when he was ran over, but Mr Alouzi confirmed Mr Kumakam's version.  He also said that another man, who remained unnamed, took off with part of the weapon as soon as Mr Bouslama was hit. 

Mr Kumakam explained that his intention was not to hurt Mr Bouslama but rather to stop him from putting others in danger, adding that the the man holding the gun seemed to be drunk.

The court ruled that Mr Kumakam was only acting in defence of other in the face of danger and his driving was a 'calculated manoeuvre' and not the result of negligence.
