TMI asks government to provide Cabinet minutes relating to controversial Mater Dei agreement

The Malta Independent has asked the government to provide the Cabinet minutes relating to the signing of the 2009 project closure agreement between the Foundation for Medical Services and Swedish contractors Skanska over the construction of Mater Dei Hospital.

The newsroom made a request to the Cabinet Office under the Freedom of Information Act.

This agreement has been at the heart of controversy over its inclusion of a blanket waiver exonerating Skanska and Maltese subcontractors Blokrete from any claims which may arise.

While the concrete used in the project was meant to be strong enough to support the construction of additional floors, should they be required, it was discovered that the material used was not up to standard when plans to build an additional floor on top of the Emergency Department to increase the number of beds were made.

The government estimates that it will cost at least €30 million – and possibly up to €50 million once tests are concluded – to address the problem.

On Sunday, John Dalli, who was Health Minister in 2009, said that he would have presented any such contract before Cabinet for discussion and approval, and the following day, the government insisted that the Nationalist Party – and particularly, members of the former Cabinet – had to assume responsibility over the case.

But on Tuesday, former Prime Minister Lawrence Gonzi said that the controversial waiver had not been seen by his cabinet, and that he would have never authorised such a provision.

In light of conflicting versions of events, The Malta Independent believes that it is appropriate for the government to confirm whether the agreement was seen and approved by Cabinet, or whether the controversial waiver was signed off behind its back.
