A man accused of dangerous driving after allegedly hitting a 10-month old baby with his truck mirror last week was today released due to a lack of evidence.

The only witness testifying in the case, the baby’s father, told magistrate Neville Camilleri that he saw the truck hitting his baby.

The father was in his Sliema home at the time while the mother was with her baby on the pavement.

At no point did the father identify the accused, 37-year-old Keith Brincat, as the driver of the truck.

The baby’s mother did not testify.

The baby suffered slight injuries from the accident.

Inspector Neville Mercieca said the truck mounted the pavement while passing through the narrow road.

Legal aid lawyer Mark Mifsud Cutajar pointed out that the baby’s father did not say the truck mounted the pavement during his testimony.

The man was cleared of dangerous driving.
