Court temporarily upholds prohibitory injunction filed by a number of gas distributors

A court today temporarily upheld a prohibitory injunction filed by gas distributors who were in danger of having their licences suspended.

The distributors were informed by the regulator for energy and water services that their licences would be suspended with immediate effect if their trucks carried the colour scheme and/or stickers of one of the LPG suppliers.

The distributors argued that this new directive was put in place merely to please “third parties” with an economic interest in LPG sales.

They said their licences do not stipulate any conditions about any stickers they put on their truck.

Mr Justice Noel Cuschieri upheld the request.

Legal procurator Ian Borg and lawyers Robert Abela and Albert Zerafa signed the prohibitory injunction.
