A judicial protest has been filed against Enemalta’s billing agency ARMS Ltd, after a user claimed that the agency ignored an agreement for him to pay three of his bills in arrears, and “negligently” cut off his electricity supply.
Jason Vella said the agreement to pay the three bills in arrears was reached on 16 December 2014, yet on the very same day ARMS filed for arbitration against him in order to recuperate the late payments.
The arbitration was deferred to September 2015.
Mr Vella said the arbitration was “unexpected” in light of the agreement reached with ARMS.
Further to this, in July of this year ARMS “negligently” cut off his electricity supply for a day, resulting in damages.
They also cut the electricity supply to the common area, meaning other residents could not make use of the lift.
Mr Vella said in the protest that he cannot continue to be held responsible for the “continuous mistakes” and negligence of ARMS.
He said he will be holding ARMS responsible for the damages incurred when his electricity supply was cut off in July, and for any further cuts that may occur.
The protest was signed by lawyers David Camilleri and Joseph Gatt.
