Two men placed on probation, assigned community service after stealing police crash helmet

Tuesday, 14 June 2016, 12:16 Last update: about 9 years ago

Two men, Joseph Cassar, 20, and David Cassar, 22, were found guilty of stealing a crash helmet from a policeman, resulting in probation and mandatory community service.

Joseph Cassar was placed on probation for a period of two years with 40 hours community service, while David Cassar has four years of probation and 80 hours community service.

They were both accused of stealing the crash helmet, a number of other items and relapsing – both had been arraigned in court previously. Both men admitted to the charges brought against them. The incident took place in Luqa on 18 March.

Joseph Cassar was acquitted of the second charge, since previous judgements resulted in conditional discharges which do not amount to a conviction. David Cassar was found guilty of both charges, resulting in a heavier penalty.

The court noted how both men suffer from psychological problems which “need to be addressed.” David Cassar also suffers from drug addiction, which the courts said also needs to be addressed. In view of this, a social worker suggested that the pair be placed on a probation order, allowing for the aforementioned issues to be tackled. It was also noted how long working hours would make it difficult for both of the accused to carry out community service.

Magistrate Doreen Clarke presided over the case while Inspector Roderick Agius prosecuted. Dr Charmaine Cherrett represented the accused.
