Mafia informer continues to fight extradition in Maltese courts

Donatella Concas appeared before the courts this morning, after she was released from hospital after she fell ill during another sitting earlier this week

The defence argued that for a European Arrest Warrant to be valid, the person in question must have been present in the court room when her sentence was handed out. The prosecution and defence then argued as to which court decision actually led to her conviction back in Italy. The defence says that she was present at the Court of Appeal for the decision, however was not present at the Corte di Cassazione.

It has also not been made clear whether the accused’s lawyer is enough to constitute a presence for such an action in Italy.

Magistrate Aaron Bugeja ordered the prosecution to speak with the Italian authorities to clarify the situation.
