Court clears three men for storing fireworks in residential area

Three more members of the Naxxar Peace Band Club organising committee have been cleared of illicitly storing explosives in a residential area.

A court cleared three members of the Naxxar Peace Band Club for illegally storing explosives within a residential area.

The men, Ivan Gauci, David Sammut and Joseph Buhagiar, form part of the band club's organising committee.

Police officers raided said band club and found a hidden room which held several boxes filled with explosions.

The officers eventually ascertained that all three men held copies of the key to the room.

The raid occurred following the deaths of two people involved in a fireworks explosion in a residential area in March 2008.

That explosion, which occurred on Triq Hal Daghjef in Naxxar claimed the lives of Paul Camilleri, 47, who was believed to have caused the explosion, and a neighbour and mother of two Sina Sammu who was 35 at the time.

The club administrator, Mark Agius, also held a copy of the key and was jailed for two years.  His conviction was recently overturned on appeal.

Magistrate Consuelo Scerri Herrera, who presided over the court, cleared the three committee members after it could not be absolutely confirm that accused knew about the explosives; neither had it been proven that they had imported or operated a gunpowder factory.
