The court's decision on the Nationalist Party case filed against the General Workers Union over an alleged breach of the terms of ground rent of the Union Headquarters in Valletta will be decided on 12 June.
Madame Justice Jacqueline Padovani Grima announced the decision date after hearing the submissions from both parties as to whether the court should put on hold proceedings or not, at least until a separate application is settled by a constitutional court.
The issue started when the Civil Court rejected a request put forward by the GWU for the recusal of the judge. The request was based on the fact that lawyers working with Fenech and Fenech, the firm owned by PN executive President Ann Fenech, had family ties with the judge.
The court had ruled that the GWU brought about arguments which were frivolous and that the court would not put off the case. The union then took the case before the constitutional court requesting the proceedings to be put on hold.
