The court took into account a pre-sentencing report drawn up on the accused, Anthony Delia, before passing judgement. The report stated that the accused was married and was trying to reconciliate with his wife. The report also said that the accused had matured a lot since the incident and had also found a job.

Magistrate Lofaro also noted that the accused gave up his job as a barman at the request of the victim’s father. She said he deserved another chance. Dr Roberto Montalto and Dr Josè Herrera appeared for the accused.
