Shop Owner fined Lm50 on lift safety certificate

Peter Bregman, proprietor of ‘The Lightshop’ in Birkirkara, was fined Lm50 by Magistrate Anthony Vella on Thursday for failing to send a lift safety certificate to the Occupational Health and Safety Authority (OHSA).

The court heard that the last certificate the OHSA received was in 2003. The authority should receive one every six months. Mr Bregman who defended his case said that he had always sent the certificates after his engineer had examined the lift in question. He said he was mystified how the authority had not received them. However, he said he would be extra careful and would be sending the certificates by registered mail in the future.

In passing judgement, Magistrate Vella said the maximum fine for such an infringement was Lm200 but as the accused had shown good faith and promised to make the necessary reforms, he would be lenient with the sentence, and a fine of Lm50 was sufficient in this case.
