Not Guilty of damaging electric cable

Emmanuel Chetcuti from Mgarr was found not guilty of damaging an electric cable after carrying out excavation work in Mgarr.

In his testimony, Vincent Camilleri, an Enemalta official, said he had gone to Fisher Street, Mgarr where some loss of power had been reported and found that a cable had indeed been damaged by excavations taking place in the area.

Camilleri said that after further investigations, it resulted that there were no permits to carry out excavation work in the area.

Appearing for Chetcuti, Dr Jose’ Herrera asked Camilleri whether he had asked the architect or the owner of the company with whom the accused was employed, if they were aware that there was a cable in the vicinity. Camilleri acknowledged that they had not contacted the architect Ray Sammut. Dr Herrera said it was obvious that his client was merely an employee obeying orders and was not responsible for damaging the cable as he was only obeying orders.
