Dom Mintoff’s Constitutional appeal turned down

The constitutional appeals court yesterday turned down an appeal filed by former Prime Minister Dom Mintoff on a judgement handed down by the Constitutional Court in March, which had rejected his request to declare that his constitutional rights had been breached.

In his original constitutional case, Mr Mintoff had called on the court to declare that his constitutional and human rights had been breached when Enemalta Corporation and the Water Services Corporation damaged his house in Tarxien and also stopped the provision of water and electricity services.

The Constitutional Court had declined this request because, it said, Mr Mintoff had other remedies, including legal ones, to turn to. The property is in Xintill Street in Tarxien.

In its judgement, the constitutional appeals court, presided over by Chief Justice Vincent De Gaetano, Mr Justice Joseph Filletti and Mr Justice Joseph Camilleri, turned down the appeal since, it said, it agreed that Mr Mintoff could seek other remedies for the damages he is claiming.
