A man was yesterday cleared of assaulting a policeman during the trade fair last year after it ruled that the prosecution had not managed to prove its case.
John Borg, 32, from Attard, was cleared of assaulting and slightly injuring police constable Christian Mifsud at the trade fair grounds on 3 July 2005.
Handing down her judgement, magistrate Consuelo Scerri Herrera said the prosecution did not manage to prove its case against Mr Borg. She said that although the police constable said that Mr Borg hit him in the face, a court expert appointed to evaluate the policeman’s injuries said he saw no injuries on the police officer’s face.
Mr Borg was also cleared of attacking the policeman and even of threatening him because the prosecution did not prove this too.
She therefore cleared Mr Borg of all the charges brought against him.
Police inspector Kevin Farrugia prosecuted.
