Court: Relapser Jailed for two years

Malta Independent Thursday, 25 January 2007, 00:00 Last update: about 19 years ago

A man who has been convicted for various crimes in the past was yesterday jailed for two years after he was found guilty of nine of the 13 charges brought against him.

Maurizio Massimiliano, 39, from Hamrun, was found guilty of stealing an alarm remote control from a car in Dobbie Street in St Julian’s on the night between 27 and 28 April 2004. He was also found guilty of damaging the car to the detriment of Marouska Camilleri.

Massimiliano was further found guilty of damaging property belonging to the government at the St Julian’s police station when he became aggressive because he did not want to enter the cell after he was arrested.

Massimiliano was also found guilty of threatening a number of police officers who had lent a hand to help control him as his behaviour worsened, violently resisting the police, breaching the peace and disobeying police orders. Finally, he was found guilty of relapsing and breaching several court orders.

The court heard how the police received an anonymous call about a man sitting suspiciously in a car and when the police went on site, they found him in possession of a screwdriver and the stolen alarm key-chain.

He was originally charged with breaking into another car but the prosecution did not manage to link the accused to the broken quarter window in this Peugeot 306.

The court heard how while at the police station, Massimiliano started banging his head against the wall, broke a window pane with his head and destroyed other furniture at the station.

Magistrate Lawrence Quintano jailed Massimiliano for two years. After the judgement was handed down, Massimiliano refused to sign a declaration which would suspend the sentence until he appeals the judgement. He was later convinced to do so.

Police Inspector Martin Sammut prosecuted while Dr Beppe Fenech Adami appeared for the accused.
