A total of 288 residents living close to Pender Place yesterday filed yet another judicial protest claiming that several of the permit conditions imposed by the Malta Environment and Planning Authority on the developers are not being adhered to.

The residents filed the judicial protest in the First Hall of the Civil Court against Mepa chairman Andrew Calleja and Mepa Enforcement Officer Omar Mizzi, holding them personally responsible for the damages they are suffering.

They explained that when Mepa granted the developers permission to begin excavation work at Pender Place and Mercury House sites, it imposed a number of development conditions including the construction of a temporary roundabout, the relocation of the present bus terminus and a condition that St Andrew’s Road is never closed to traffic.

Moreover, the residents complained, the developer had to submit a plan on how it will be monitoring the vibrations and noises on site as well as a monitoring programme of the quality of the air. They also mentioned a number of other conditions including one which stipulates that the developer had to appoint an Operational Management Consultant.

The residents claimed that these conditions were not being adhered to and that although they wrote to Mr Calleja to inform him about this and verbally informed Mr Mizzi, nothing improved.

They warned that they will be holding Mr Calleja and Mr Mizzi personally responsible for the damages they are sustaining due to the illegal activities taking place on site in connection with this project.

The protest was signed by Professor Ian Refalo, Dr Mark Refalo and LP Edgar Montanaro.
