Malta’s Permanent Representative Richard Cachia Caruana seems to be muddled and confused. In his letter of 17 June “Who has the last word?”, he makes a number of incorrect statements in response to my earlier letter.

Mr Cachia Caruana starts of by reading much doom mongering and prophecy in what was a factual description of the court proceedings. He then mistakes me for FAA’s lawyer despite my having stated that I represent another group of plaintiffs who have sought to challenge the Maltese government regarding the so-called rationalisation exercise.

Finally, he pounces gleefully on my letter as some sort of hard-won victory where I was cornered into admitting that a court pronouncement exists. I have never denied that such a decree exists.

It was issued in regard to a request by plaintiffs for the issue of a warrant of prohibitory injunction. It is not a final decision on the outcome of the case and should not be interpreted as such, despite what mixed-up high-ranking civil servants choose to report in the press and elsewhere.
