The Court of Criminal Appeal has revoked a judgement handed down by a magistrates’ court, and cleared a man of involuntarily seriously injuring a boy after the boy was hit by the car the man was driving.

Christopher Siegersma had been fined Lm25 after he was found guilty of driving recklessly and involuntarily seriously injuring Shaun Spiteri on 21 July last year. The boy suffered a broken arm after being hit by the car driven by Mr Siegersma.

However, the Court of Criminal Appeal found that Mr Siegersma had actually been driving vigilantly, but the boy had suddenly decided to cross the road. Although he had attempted to use the pedestrian crossing, the court found that the boy had crossed the road diagonally.

The case was presided over by Mr Justice Joseph Galea Debono.
