A correctional officer at the Corradino Correctional Facility yesterday filed a case within the First Hall of the Civil Court in its Constitutional Jurisdiction claiming his fundamental human rights had been breached.
Emanuel Cassar filed the case against the CCF Director General and the Attorney General.
In his writ, Mr Cassar explained that he had to appear before the CCF Disciplinary Board to answer to a number of charges involving alleged misconduct. He had asked for his lawyer to be present during the sitting but this request was turned down.
Mr Cassar claimed that this violated his human rights since everyone, whether in court or before a tribunal, has the right to be represented by his lawyer.
He therefore called on the court to rule that his human rights had been breached and order action as deemed necessary.
