Servizi Malta, comprised of Bad Boy Cleaners, Euro Hygene Ltd and MCSS Co Ltd, yesterday filed a judicial protest in court against the Director of Contracts.

The complainants said that the protest was in connection with the call for applications to service the cleaning sector of the Mater Dei Hospital. The complainants also claim that G4S Security Services, which is being considered, is not cut out to carry out the work as put forward in the relevant Memorandum and Articles of Association.

They also pointed the finger at Forestals Investments Ltd, saying that this company (part of G4S) should also not be in the running. The complainants said that the two companies’ objectives do not include the provision of cleaning services.

The complainants also said that they were excluded from selection because of an alleged deficiency in their bid bond, adding that if there was indeed a deficiency, it was insignificant in both numerical and real terms. The complainants said that this was insignificant because the contract should be issued before the bid bonds even expire. In closure, the complainants requested the Director of Contract to declare the only remaining offer to be disqualified so as to allow all interested parties to better guide themselves and to make sure that all are treated in the same manner with the same rigorous attention to legal detail.

Dr Andrew Borg Cardona signed the judicial protest.
