A TV production house yesterday filed a counter-protest against another production company that is claiming breach of commercial copyright of a music jingle used in an advert.

Last week, 26th Frame Ltd filed a judicial protest against Clare Agius Media Productions Ltd and Alan Pace, owner of Active Zone Health and Fitness Club.

The complainant said that Mr Pace was broadcasting a number of adverts on TV stations that were accompanied by a musical jingle called Closing Score and that this jingle was the signature theme of the television series Pupi – that they created and produced and, as a result, belongs to 26th Frame.

The complainant said that Mr Pace did not get permission before the adverts were broadcast to use the jingle for the commercial reasons.

In a counter-protest filed yesterday, Clare Agius Media Productions Ltd and Mr Pace claimed the allegations put forward by 26th Frame Ltd are totally unfounded.

They said the music accompanying the advert under consideration (which was produced in September last year and broadcast between October 2006 and March this year) was different to the one that 26th Frame Ltd made reference to.

26th Frame had pointed out that it never gave permission to Mr Pace or Clare Agius Media Productions Ltd to use or produce the music jingle Closing Score, but the other production house denied that they ever used this jingle.

Moreover, 26th Frame Ltd opened their complaint last month and from then on, the advert under scrutiny was transmitted during another programme, not one produced by Clare Agius Media Productions Ltd.

Dr Antonio M. Tufigno and legal procurator Luisa Tufigno signed the writ.
