The Magistrates’ court yesterday conditionally discharged a former postman for two years after he was found guilty of failing to deliver 111 registered letters.

The court, presided over by Magistrate Audrey Demicoli, heard how Marco Formosa breached the oath he took when taking on the job as postman when he kept 111 registered letters, without opening them, between October 2003 and February 2004.

Formosa, who was employed as a postman with Maltapost, explained to the court that he did not deliver the letters as he had personal problems and could not keep up with the workload.

However, Magistrate Demicoli pointed out that if Formosa felt that he could not keep up, he should have informed his superiors.

The court heard how Formosa had undergone disciplinary proceedings at work and lost his job.

In handing down her judgement, Magistrate Demicoli noted that Formosa had personal problems, that he did not open the letters and that his criminal record was “almost clean”.

As a result, Formosa was found guilty and conditionally discharged for two years.

Police Inspector Joseph Agius prosecuted.
