With reference to Gavin Gulia’s article (TMID, 12 January), Alternattiva Demokratika would like to request Dr Gulia to desist from making incorrect statements in AD’s regard. In the said article Dr Gulia wrote that “On the premise that he lost his passport, the Courts, in 2003, could do nothing to stop Arnold Cassola of Alternattiva Demokratika from voting at the referendum and the general elections”.

This is totally incorrect. Prof. Cassola never said he lost his passport. In fact, when asked by the Court, Prof Cassola presented his valid passport to the courts immediately.

Dr Gulia should update himself with what happens in the Constitutional Court. In the Cassola case, in March 2003, the Constitutional Court gave the following definition of “residence”: “Residence does not necessarily mean physical presence in Malta but habitual presence”.

It is on this basis that Maltese living abroad have a right to vote in Malta.
