The Constitutional Court, presided over by Mr Justice J. R. Micallef recently found that a man, Nicolai Magrin had been charged twice for the same crime and therefore his constitutional rights had been infringed.
On 4 July 2006, Mr Magrin had been charged with having hit an elderly man, Giuseppe Cuschieri (father of former MP Joseph Cuschieri) in Tower Road, Sliema at 8am on 29 April 2006
On 24 October 2006, Mr Magrin was found not guilty since the facts that may have led to the charges against him took place at a very different time.
On 28 November 2006 Mr Magrin was again charged with having run over Mr Cuschieri but the time of the accident was put at 8pm
Mr Magrin claimed he had been charged twice for the same crime and a series of court appeals led to the latest court judgement, which found that he had been discriminated against.
