Court: Mambra Owner argues sequestered property is on different company name

Joseph Pavia, on behalf of Mambra Food and Beverage, filed an application before the First Hall of the Civil Court to revoke a prohibitory injunction by which his residence in Santa Maria Estate, Mellieha, was sequestered by the court.

Mr Pavia’s electronics establishment in Luqa closed for ‘shutdown’ last summer and never re-opened, leaving many customers dismayed. The company also had huge pending tax bills, including income tax, VAT and eco-contribution dues amounting to over €1 million.

A previous court decision ordered the Santa Maria Estate property to be transferred to the government. However, Mr Pavia argued the property was under the name of Mambra Food and Beverage and not Mambra Electronics, or on his name. Companies have distinct jurisdiction personalities and since Mambra Food and Beverage owed the government no money, it had no right for pretences against the company.

Mr Pavia, on behalf of his food and beverage company, requested the court to partially revoke the prohibitory injunction and declare it should not apply for the property in question.

The application was signed by lawyers Jose Herrera and Veronique Dalli.
