Divorce has existed in Maltese legislation for many years, though it is only available to couples who, by changing their temporary residence to another country, file divorce in their new country of residence. This divorce is recognised by Maltese law.
This means that the divorce procedure is only available to couples who are able to afford it and who have a mutual agreement to seek divorce. All other couples who are already separated live in a legal limbo as no law regulates their situation.
The introduction of the Bill by Jeffrey Pullicino Orlando and Evarist Bartolo would create that legal framework. The role of the parliamentarian is to legislate and to ensure that the rights of the minority are preserved.
Divorce exists already, it just needs to be made available to the ones who cannot afford to seek it through foreign residence.
