I write with reference to the report published in The Malta Independent on Wednesday 28 March bearing the title ‘Developer makes threat claims in court’. Heritage Malta would like to correct the report with the following:

Contrary to that indicated in the report, during his evidence in court, Kenneth Gambin, Chief Curator of Heritage Malta, stated that Chris Delia, an employee of Heritage Malta was only involved in the first stage of the adjudication process that is the administrative stage.

Furthermore, it must be pointed out that Mr Delia’s involvement was as a member of a committee composed of three members and in no way did he decide who was to be disqualified.

In the second stage where the technical competency of the applicants was adjudicated, Mr Delia was not part of the adjudicating committee.

Mr Gambin further explained that both the final recommendation of the administrative stage and that of the technical stage was a unanimous decision of all the members of the adjudicating committee. In both phases, and as happens in similar cases, Heritage Malta forwards the recommendation of the members of the committee to the Department of Contract, which in turn takes the final decision. Heritage Malta reserves further comments with regard to this case given that proceedings in court are still pending.
