Court revokes travel ban on woman whose partner claimed she wanted an abortion

A court has lifted a travel ban imposed on a woman whose partner claimed she wanted to go abroad to have an abortion.

The woman’s ordeal was revealed on Thursday by the Women’s Rights Foundation.

The WRF is fighting a legal court case on behalf of the pregnant woman.

“She has been faced with a warrant placed on her person, prohibiting her from travelling following false allegations by the perpetrator that she plans to have an abortion abroad. This is not only contrary to her right to freedom of movement, but also is in breach of her fundamental right to privacy and blatant gender discrimination just because she is a woman”, WRF said.

On Friday, the court, presided by Madam Justice Anna Felice, revoked the preliminary injunction barring the woman from travelling. The court said there was no valid reason at law to stop the free movement of the woman.

It said it found no proof that she intentend to travel for an abortion, as claimed by the man.

“Abortion is a crime in Malta so the plaintiff should file his report with the police if and when there is any suspicion of that,” the judge said.

In a Facebook post, WRF welcomed the court decision, adding that the woman is again free and her rights have been restored.
