TMID Editorial: Case closed? Far from it

This week saw more seismic developments in the Daphne Caruana Galizia case, with the first testimony of Vince Muscat in court against the two Degiorgio brothers who are accused of being his co-conspirators in killing the journalist.

Muscat testified after pleading guilty to his involvement in Caruana Galizia's murder - a crime which he will now spend 15 years behind bars for.

His guilty plea led to the arrest of four other people in connection with the Caruana Galizia murder, as well as a separate murder - that of Carmel Chircop - a couple of weeks ago. Those arrested included the people suspected of having supplied the bomb which ultimately killed Caruana Galizia on 16 October 2017.

In announcing these major developments, Police Commissioner Angelo Gafa said: "With the evidence we have, we are in a position to say that every person involved, be it mastermind or accomplice, is under arrest or facing charges."

Although he didn't explicitly say it, Gafa certainly gave the impression that this was effectively case closed.

The developments in court on Thursday most definitely show that this is not the case.

In the compilation of evidence against the Degiorgio brothers, Vince Muscat testified that one of the brothers used to meet former government minister Chris Cardona - at Castille no less - and that Cardona used to feed them information about when the police raid which led to their arrest would be taking place.

He name-dropped former Assistant Police Commissioner Silvio Valletta as someone who leaked information, he name-dropped lawyer David Gatt as someone who knew about the murder and said that it was former OPM chief of staff Keith Schembri who had told Gatt about it - implying that Schembri knew about the murder plot as well.

We must of course keep in mind that this is the testimony of one man, and much of it is based off of what he was allegedly told by the Degiorgio brothers; but the fact remains that the extent of some of these revelations is startling.

Let us not forget that Muscat was testifying under oath and that he was granted a plea bargain by the prosecution - which certainly implies that he has a certain level of credibility. If he is found to be lying in his testimony, he will no doubt lose the deal that he obtained.

Chris Cardona in particular has denounced the claims as "pure evil fiction".

Now, there is no doubt that we will hear more on these revelations in court in the possibly not so distant future. Maybe then we will get a much clearer picture than now on what is actually truth or what is, as Cardona put it, fiction.

Till then however, we must go back to Gafa's statement a couple of weeks ago. When saying that every person "involved" in the murder is under arrest or facing charges, the key word here is "involved."

How does one define "involved"? Maybe Gafa meant to say "directly involved" or maybe he didn't - it's not our place to put words into his mouth.

For us though, involvement can extend far beyond being the triggerman, the supplier, or the mastermind.

If someone was providing information to the hitmen - then that is involvement. If someone was leaking information from the police - then that is involvement. If someone even so much as knew of the plot and didn't say anything - then that too is involvement.

Is this to say that the people named by Vince Muscat are all 'involved' as defined above? Again, that is not our place to say - but due process must be done, investigations must be conducted, and if Muscat's assertions are proved to be true, then those named must face justice.

What we can definitely say, however, is that this is very from "case closed."
