Court rules Yorgen Fenech’s right to presumption of innocence not breached by PN MP's comments

Yorgen Fenech's claim that his right to the presumption of innocence was breached by PN MP Beppe Fenech Adami was dismissed by the courts.

The breach was claimed by Fenech after the MP associated the murder of Daphne Caruana Galizia to the Electrogas project. The MP had claimed that Caruana Galizia was murdered because of corruption in the Electrogas agreement.

Magistrate Rachel Montebello ruled that the MP did not pin the murder on Fenech when he had addressed the Public Accounts Committee, while at the time was grilling Electrogas shareholder Paul Apap Bologna.

The court, however, did have some stern comments to make to the MP, saying that he should be more careful before making political comments during a meeting of the parliamentary committee. The court said that the assassination and opinions about the motive of the murder were not funcitons assigned to the PAC.

The court said that it expects public roles to be fulfilled with utmost seriousness and not be used for politically loaded comments.
