Prosecutors on Friday continued delivering its closing address to jurors in a trial of the 4 men charged with the murder of Caruana Galizia and Chircop.
The trial has now been going on for more than a month. The accused are 'Ta' Maksar' brothers, Robert and Adrian Agius, Jamie Vella and George Degiorgio.
Vella and Robert Agius, Adrian's younger brother are accused of complicity in the murder of journalist Daphne Caruana Galizia by supplying the bomb that killed her in October 2017.
Adrian Agius is charged with commissioning the murder of lawyer Carmel Chircop in 2015. Prosecutors insist that the hit was also carried out in complicity with Jamie Vella and George Degiorgio who are accused of executing Chircop's murder.
All four accused deny the charges against them.
The prosecution on Friday said that testimony from Vince Muscat about the murder of Chircop was corroborated by crime scene evidence and CCTV footage. It argued that theories by the defence that the accused were not responsible are contradicted.
Photos of the Chircop murder scene were shown. The prosecution described the dynamics of how the bullets entered and exited Chircop, and showed photos from the autopsy.
The prosecution explained that the entry and exit points indicate shots were fired from someone seated, adding that it was likely the shooter was in a car.
The evidence supports Vince Muscat's version of events, the prosecution says. "I'm not the type of person that comes here to scream and try to sell you a version of events that did not happen," prosecutor Anthony Vella says. "I rely on evidence."
He said that witnesses, investigators and Muscat gave similar descriptions of what happened on the morning of the murder of Chircop.
Turning to the Caruana Galizia murder, Vella said that the versions given by Muscat and Melvin Theuma match.
The prosecution also said that Muscat's testimony about the Caruana Galizia murder matches evidence gathered, mentioning, for instance, a cigarette butt at one of the vantage points near the victim's home which contained traces of Alfred Degiorgio's DNA. Another such instance, he said, is when he described the dimensions of the explosive used.
The prosecution went over data gathered by investigators regarding the burner phones and their movements, and the jury is shown how investigators tracked the locations of calls made by the phones used in the murder.
The data confirms Muscat's testimony, the prosecutor says, including the time when the bomb was turned on and when it received the detonating message
The jurors are told that when the bomb was turned on, it was located in a garage belonging to Robert Agius that was also used by Jamie Vella, and that on another occasion when it was turned on, it connected to a cell tower near the Maksar brothers' villa.
The prosecution went over the run-up to the Caruana Galizia murder according to Melvin Theuma and Vince Muscat, saying that the version of events of both match up.
Prosecutor Vella said the accused has no assets in their own name, saying that garages were reted, and that vehicles and weapons were registered under the names of other people. He said they used burner phones to limit the trace of their involvement in the two murders.
He noted 25 mobile phones were found in the accused's homes, and that the subjects knew of the upcoming arrests. "These people are very careful."
"Why would Vince Muscat point his finger at the accused if they weren't involved in the murders?" the prosecution asked.
The prosecution explained the charges to the jurors, and tells them to see their decision as a checklist of questions.
He asked:
"Were the accused George Degiorgio and Jamie Vella responsible for the death of Carmel Chircop after they shot him from their car?"
"Did Carmel Chircop die from this aggression?"
"Was the murder of Carmel Chircop illegal?"
"The answer is a resounding yes," Vella told jurors.
The prosecution said investigators didn't simply rely on the testimony of Vince Muscat. "We wouldn't be here today if we didn't believe this testimony," he said. He said the testimony was corroborated by evidence.
