BCA contraventions amounted to €808,400 since 2022; €166,400 remains unpaid

Contraventions issued by the Building and Construction Authority (BCA) have amounted to €808,400 from 2022 till 2026, with €642,000 paid to the BCA, leaving the remaining €166,400 unpaid.

Opposition MP Mark Anthony Sammut asked the Minister for Infrastructure, Planning and Employment Jonathan Attard, to detail the total amount, in monetary terms, that has been requested by the BCA through contraventions in accordance with subsidiary legislation 623.06, as well as how much of this total has been paid to the Authority.

Sammut was referring to regulations pertaining to the avoidance of damage to third party property.

The 2019 legal notice for this subsidiary legislation states that "the scope of these regulations is to ensure that before the start of any type of works consisting of demolition, excavation, or construction, methodologies that are technically secure are prepared in order to minimize the risk of damages to third party property or injury to persons that may result through the proposed works."

Minister Attard provided the data as requested, showing a year-by-year breakdown of BCA contraventions requested and how much from them was paid.

In 2022, €62,350 worth of contraventions were issued by the BCA. Just less than half of this amount (€30,500) was paid.

In 2023, contraventions totalled to €190,600 - of which, €170,150 was paid, thus leaving €20,450 pending.

In 2024, the total amount of money sought by the BCA through these contraventions amounted to the annual high for this four-and-a-half-year period at €273,950.

From this, €244,950 was paid off, leaving €29,000 unpaid so far.

Last year, in 2025, BCA contraventions amounted to €192,750 and €145,000 was paid to the Authority.

In 2026 so far, €88,750 in BCA contraventions was requested and €51,400 was paid.

The Building and Construction Authority (BCA) was officially established in August 2021.
