Court: Tribunal Declares notice of contravention null and void

A man who received a fine after he was allegedly recorded by a speed camera to be over-speeding on the Regional Road, has been cleared of the charge after the tribunal’s chairman declared the notice of contravention sent to the man as null since it was not accompanied by a reason why the notice was not served on the spot.

The decision was handed down by Dr Robert Mangion, who presided over the local tribunal in the case, St Julian’s local council vs Brian Mizzi.

Mr Mizzi was charged with exceeding the speed limit after the speed camera installed at Mikiel Anton Vassalli Street took a photograph of the car on 31 January. The tribunal upheld the plea raised by Mr Mizzi’s legal counsel that the notice of contravention was null and void since it was not accompanied by a reason why the notice was not served on the spot as laid down in the relevant legal notice.

Dr John Ludovic Gauci represented Mr Mizzi.
