Court: Youth Charged with causing death of athlete through negligence

Malta Independent Tuesday, 22 January 2008, 00:00 Last update: about 12 years ago

A 25-year-old man was yesterday charged with causing the death of athlete Emanuel Formosa, 59, from Mosta, by running him over with his car on Sunday at 6.30am, while driving under the influence of alcohol.

Kevin Ellul, also from Mosta, who lives just a few metres from the spot were Mr Formosa was found dead in Durumblat Street, pleaded not guilty to reckless driving, by which he caused the death of Mr Formosa.

He also pleaded not guilty to driving in a public place while not being in the condition to do so, and driving while having excessive levels of alcohol in his system. He was also charged with failing to stop after being involved in an accident.

Both the prosecution and defence agreed that Ellul should be granted bail, without the need for the accused to report at a police station. Magistrate Anthony Vella granted him bail against a personal guarantee of €5,000 (Lm2,146.50).

Police Inspectors Daniel Zammit and Therese Sciberras prosecuted, while Dr Emanuel Mallia appeared for the accused. Dr Joe Brincat appeared for parte civile.
