Company To pay e6,290 in damages for unfair dismissal

An industrial tribunal condemned Dhalia to pay a former accounts assistant e6,290 in compensation for her unfair dismissal.

The tribunal, presided over by Alphonse Caruana, heard how Diane Bayliss was employed on 17 February 2004 as a part-time accounts assistant and started working on a full-time basis on 1 October of the same year.

She claimed trouble started after she started working on a full-time basis and was given a warning. On 15 April 2005, she was given a second warning; however, she never learnt its motivation.

Things took a turn for the worse after she informed one of her superiors that she was pregnant.

As time went by, she could not fit into her company uniform and bought matching clothes out of her own pocket. However, her superiors informed her that she ought to continue wearing the uniform.

The tribunal heard how one of her superiors used to scold her for errors committed by other people. By the end of March, the company decided that it could not cope with Ms Bayliss’ frequent tardiness and absenteeism.

For her part Ms Bayliss said the company made her life miserable due to her being pregnant and wanted to get rid of her.

The tribunal held that Ms Bayliss did sometimes carry out her work in a sketchy manner, but her dismissal was still unfair.
