A 30-year-old man was jailed for a total of five years and fined e3,000 after he was found guilty of possessing heroin and cocaine in circumstances showing they were not for his exclusive use and relapsing.

Glenn Busuttil, from Valletta, was arraigned on two separate charges; he was charged with possessing heroin at Sa Maison on 14 June 2007 and possessing heroin and cocaine, introducing the drugs at the Police HQ on 30 October 2007.

The court, presided over by Magistrate Lawrence Quintano, heard how on 14 June 2007, a mobile squad patrol caught Busuttil in possession of 13 sachets containing 2.043 grammes of heroin and five mobile phones while parked at Sa Maison Hill.

The police found he had received an order via text message which also warned him of police patrols.

He was found guilty of the charges relating to this incident and was jailed for two years and fined e1,400.

Busuttil was also charged with possessing 2.11 grammes of heroin and 6.65 grammes of cocaine at home.

He was also found in possession of e5,308.64, a metal pipe blackened by smoke as well as a number of mobile phones and a laptop computer.

He was taken to a lock-up at the Police HQ where two sachets containing heroine and another one containing cocaine were found.

The court deemed that there was not enough evidence to prove that Busuttil wilfully introduced drugs in the place of detention; however, he was found guilty of possessing the drugs and relapsing.

He was jailed for three years and fined e1,600.
