Court: Jailed For six years, fined €15,000 for dealing in cocaine, ecstasy

A 24-year-old man who was due to stand trial for drug trafficking has been given a six-year jail term and a €15,000 fine. He pleaded guilty to dealing in and being in possession of cocaine and ecstasy. Jorgen Brincat had admitted that he used to sell about 10 grams of cocaine a week. Before the police intervened on 20 October 2005, Brincat had bought nine grams of cocaine for about Lm350 (€815.28). He had divided the cocaine in 17 bags, which he intended to sell for Lm30 (€69.88) each. The police had found the bags of cocaine at his residence. As for the ecstasy, Brincat used to sell the pills for about Lm5 (€11.65), making a profit of about Lm2 (€4.66) on each pill. The police had found one ecstasy pill at his residence in Sliema. On the day the police intervened, Brincat had agreed to meet Bjorn Bartolo. They had planned to deliver 100 ecstasy pills to someone. The court, presided over by Mr Justice Joseph Galea Debono, noted that the prosecution was inconsistent by changing its request regarding the punishment. The prosecution requested a punishment of less than 10 years at the last moment. At the same time however, Mr Justice Galea Debono wrote in his judgement, the prosecution “requested a life sentence four times!” He went on to say that the prosecution could have easily issued a counter-order for the case to be decided in the magistrates’ court.
