Mr Micallef had begun working for catering company Mannarinu Ltd in 2002 as a kitchen helper. The application states that "for the past twelve years, he was always competent in his work and never received any form of warning, however suddenly, of 15 September this year he received a phone call from Company Director Noel Borg stating that he was accused of stealing a carton of eggs. In the same conversation, he was told that he cannot attend work, resulting in his termination".

The application adds that Mr Micallef received a letter from the work accountant stating that he (Mr Micallef) had an argument regarding work and that he decided to stop working.

Mr Micallef contacted the company and asked for the letter to be changed however the company refused, the application read.

Dr Joseph Gatt is representing Mr Micallef.
