Lawyer contests arrest of Libyan charged with injuring policeman in Paceville

Lawyer Gianella DeMarco today contested the arrest of 33-year-old Munir Mohamed Ali Gammudi, who is being charged with injuring a policeman.

The incident happened on the 18 of October, on St Rita Steps in Paceville, when an off duty policeman was injured, allegedly by Mr Ali Gammudi, who had a knife in his possession. It all started when Mr Ali Gammudi threw a glass at a group of people, and when he was ordered the stop by the police, he produced a knife, and spit at the policeman. He was then arrested, and admitted to Mater Dei, because he was unconscious.

The defence counsel argued that the accused should have been effectively released, after he was not apprehended in court within 48 hours. The prosecution argued that the accused was informed he was released, but failed to produce the release forms in court.  Dr DeMarco said that no interpreter was present when police informed Mr Ali Gammudi of the release, and police officers were present in the hospital ward throughout.

Inspector Elton Taliana argued that the accused had breached his bail conditions, and should have not been out at the time of the incident.

Magistrate Giovanni Grixti declared the arrest justified.
