Constitutional Court requested to take into account content of inquiry report on Darryl Luke Borg

Two lawyers yesterday made a formal request to the Constitutional Court to order an “authentic copy of the inquiry report into Darryl Luke Borg’s arrest and to take into consideration its content”.

The request was made after it was reported that the conclusions of the report show that Mr Borg, 27, of Birkirkara, was innocent and that his arrest in an armed robbery case was one of mistaken identity.

Mr Borg was arraigned and charged with a hold-up at a Convenience store in Birkirkara on 7 August 2013 but it turned out that he was mistakenly arrested by two CID inspectors. Another person had been arraigned in connection with the hold-up by another police inspector.

Borg initiated legal proceedings, stating that his human rights were breached and he also made a request for compensation. The request for compensation was turned down by the First Hall Civil Court. He appealed the case and the Constitutional Court is to make its decision on 27 March.

Lawyers David Camilleri and Joseph Gatt signed the application on behalf of Mr Borg.
