Transgender, variant and intersex inmates policy launched for prisoners

A new transgender variant and intersex inmates policy will have transgender prisoners assigned to sections that match the gender which is shown on their legal documents.  

The policy was launched this morning by Home Affairs Minister Carmelo Abela and Minister for Civil Liberties Helena Dalli. Until this day, prisoners were assigned to divisions which reflected the gender listed on their respective birth certificate.

The Ministers explained that the inmate will be making a declaration under oath to be admitted to the appropriate division.  An inmate can be moved to a separate division for further assessment. However this assessment cannot last longer than seven days.

According to the policy, searches will also be carried out by a prison official of that particular gender. Training for staff will also be given.

They explained that inmates will have more access to information regarding gender identity and health issues related to the transition. “This policy is based on the values of equality, inclusion and recognition of diversity,” Minister Abela said.
