Man acquitted as magistrate chastises police for poor investigation

A man was found not guilty of threatening a woman ad indecently assaulting her, after a court ruled that the police had not carried out a proper investigation.

It had been alleged that at 12:30pm on 3 March 2017 at the Waste Serve facilities in Xewkija, that 30 year old Gozitan Denis Saliba had grabbed Maria Margo by the head and shoulders while she was loading mattresses into a container.

The court, presided over by Magistrate Joseph Mifsud, ruled that the Official Prosecutor in the case had not taken a statement from Mr Saliba nor spoke to Ms Magro prior to charging the accused.

The original inspector did not even see the CCTV footage or speak to other persons who could have given more information about the incident.

The CCTV footage was provided to the courts and did not even show where the alleged incident took place.

The original officer also said that she would not be a witness in the case.

The prosecution was represented by Inspector Edel Mary Camilleri.

Dr Kevin Mompalao represented the accused.
