Former Labour Minister Joe Brincat hits out at magistrates who are more interested in making waves

Former Labour Minister and a lawyer Joe Brincat hit out at magistrates who are more interested in "rocking towers" and "making vibrations" across Malta through their declarations.

He was arguing in favour of bail for his client, Daniel Cremona, who is accused of multiple counts of theft.

Brincat told presiding Judge Edwina Grima that the efficient magistrates in Malta's law courts are the ones who "talk less and listen more".

Such magistrates are more interested in taking decisions in peace and quiet, with serenity, he told the court. Brincat was delivering an impassioned speech on the merits of why his client should receive bail. He is accused of robbing multiple petrol stations and wilful damage.

CCTV footage allegedly connecting him to the crime was not yet presented, meaning that at the time of the arrest, and the time of the bail hearing this morning, there was not enough prima facie evidence to support him being remanded in custody, he said. Brincat stressed that the presumption of innocence could not be ignored, despite Cremona's checkered criminal history.

Brincat was dressed down this morning, without a jacket or tie, to which he asked Madam Justice Grima's exception, quipping that his client who is trying to be released on bail appears to be the lawyer out of the duo, for he was dressed in full jacket and tie.

He contended that at this stage, without anything connecting his client to the crime, his arrest is illegal.

Lawyer from the office of the Attorney General, Justine Cilia, contested the assertion that the arrest was illegal, and objected to bail due to the likelihood of Cremona committing another crime of that nature. Madam Justice Grima will be deciding on whether to grant the request at a later stage.
