Seawatch 3: ECHR tells Italy to provide medical care and basic supplies

An interim measure was granted concerning the SeaWatch 3 vessel which is currently anchored outside of Syracuse, Sicily.

The Court has not granted the applicants' (SeaWatch's) requests to be disembarked, although it did request that the Italian Government "take all necessary measures, as soon as possible, to provide all the applicants with adequate medical care, food, water and basic supplies as necessary" in an interim measure.

"As far as the 15 unaccompanied minors are concerned, the government is requested to provide adequate legal assistance (e.g. legal guardianship). The government is also requested to keep the Court regularly informed of the developments of the applicants' situation."

The request was received by the ECHR on the 25th January, and the application was lodged by the captain of SeaWatch 3 and one of the migrants on board.

A second request was lodged on the 28th January by the 15 unaccompanied minors on board.

The applicants had requested that all 47 migrants on board be allowed to go ashore since the situation on board the vessel was precarious and the migrants were in poor health.

The SeaWatch 3 has had the migrants on board since the 19th January, and, since then, both Malta and Italy have refused to let them dock.

Italy, under the direction of Interior Minister Matteo Salvini, has continuously refused to allow the disembarkation of the migrant ship until the migrants relocate to Netherlands or Germany.
